Auction Bidding Terms and Conditions


PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY PRIOR TO REGISTRATION AND BIDDING for THE BERSTEN ANTIQUE COFFEE AND TEA COLLECTION AND MUSEUM.

BY BIDDING IN THIS AUCTION, OR WHERE YOU OFFER TO PURCHASE THE COLLECTION BY PLACING THE HIGHEST BID, YOU AGREE TO THESE CONDITIONS OF SALE AND THE SALE CONDITIONS SHALL BECOME CONTRACTUALLY BINDING ON YOU.

  1. AUCTION INFORMATION.. Intending bidders need to be aware of the information about the Auction available from the www.berstencollectionauction.com website, including auction duration, product catalogue, bidding increments (Minimum $5000 increments) and the latest bid. Auction Officials may vary the increments during the course of the auction at our discretion.
  2. REGISTRATION and BIDDING ACTIVATION. If you intend to bid online you must complete the Online Bidder Registration Form, which is available after acceptance of these Terms and Conditions.

    After filling out this Online Bidder Registration Form you will receive a confirmation email that states your password, bidder number and a link that enables you to validate your email and account.

    Once you have validated your email, you are invited to Upload a copy of your Drivers Licence for Australian residents and a copy of your Drivers Licence and Passport for International bidders.

    Once your identity has been checked by auction officials, you are invited to pay a $1000 Fully Refundable Security Deposit through Paypal.

    When this deposit is paid and validated, you are able to view the Live Auction page, view bidding history and place a bid. Your ability to bid will be then activated and you will receive a notification by email that you are now able to place bids from 1st January 2015. You will also receive email notification if a higher bid is placed.

    Bids may only be submitted between the dates and times specified on the website, that is, between Midnight on 31st December 2014 to Midnight on 1st May 2015 EST.

    All bids are made in Australian Dollars $AUD.
  3. INSPECTION.. All items are sold on an AS-IS basis therefore visiting the Museum in Mareeba and prior inspection is highly recommended. Where possible bidders should view the Collection/Museum in person.
  4. RESERVE PRICE.. The Bersten Antique Coffee and Tea Collection and museum is subject to a reserve, which is the confidential minimum price the seller will accept and below which the lot will not be sold.
  5. FULLY REFUNDABLE SECURITY DEPOSIT.. The Fully Refundable Security Deposit of $1000 AUD will be refunded as soon as a registered bidder emails Auction Officials their intention to not to continue in the bidding process. Their account will then be deactivated and they will no longer be able to place bids. The refunds can only be made to the account from which the payments were originally made.
  6. AUCTIONEERS DISCRETION. . The ONLINE Auctioneers decision is final and there will be no negotiation after the fall of the hammer. The Auctioneer has total discretion in choosing to accept a bid from the Internet and may, without giving any reason, refuse to accept the bidding of any person or persons. The Auctioneer reserves the right to deactivate your account and also reserves the right to close the auction prior to the date seen on the website.
  7. AUCTION TRACE. . A detailed trace of the auction events is available from the Live Auction page available after registration. People viewing this trace are advised that Internet delays and the response time of the site mean that bid limits may affect the speed at which updates occur.
  8. TRANSFER OF OWNERSHIP. . Goods become the responsibility of the purchaser after the fall of the hammer, however cannot be removed from site until payment has been made in full. Bidders are required to contact our office to process full payment and provide instructions for collection, packing, storage or delivery as soon as possible after the sale of the item on Auction Day.
  9. PAYMENT.. Auction Officials may require the production of bank or other financial references or documents to prove that you meet certain qualifications.

    PAYPAL Cannot be used for payment for purchase of the collection on the fall of the hammer. The purchase price is to be paid in full by Direct Deposit or Wire Transfer. Full payment must be made within 24 hours of the winning bid. The winning bidder will be contacted with the bank account details for Direct Deposit or Wire Transfer of the final bidding price.
  10. COLLECTION OF GOODS. . All goods must be removed from the Coffee Works Mareeba site within 1 month of the final day of Auction. Packing and Shipping and all other associated costs are the winning bidders responsibility and expense.
  11. ACCEPTANCE. . By accepting these terms and conditions you warrant that you are at least 18 years of age and able to enter a legally binding contract, that you will be financially responsible for your use of the Auction system and that you will be responsible for any usage by minors or any other party of these auction services under your name or account.

    Please guard your password like you would a pin number on a bank account and do not leave your computer unattended while logged into the system.

    By accepting these terms and conditions you give permission to museum Auction Officials to use the supplied address and other details for verification purposes and to contact you regarding the auction activities.
  12. The Collection/Museum: . lot is sold as is. No claim for damage, incorrect descriptions, genuineness or authenticity will be entertained. Bidding price is GST free. Any uncollected goods will be resold or disposed of.
    Other Auction Rules
  1. All bids placed at auction are made on a one-lot basis for the whole Collection/Museum and amounts may only be increased by multiples of the bid increment ($5000). You are not able to lower your price with a new bid.
  2. We serve the right to close the online auction prior to or extend it beyond the posted closing time. This may be done at our discretion and without warning. We also reserve the right to sell the Collection/Museum prior to Auction.
  3. We will make every effort to ensure system availability. In the event of technical difficulties, we are not responsible for bids that are not accepted or processed.
  4. Fraudulent bidders using invalid or stolen identity details or fraudulent registrations will be prosecuted to the fullest extent of the law.
